INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA Art. 13 EU REGULATION 2016/679

E-mail: comunicazione@starwood.it, in its capacity as “Data Controller”, hereby informs you that the personal data collected will be processed in compliance with the above-mentioned legislation, in order to guarantee fundamental rights and freedoms, as well as the dignity of natural persons, with particular reference to confidentiality and personal identity.
  1. Source of personal data

Pursuant to Article 13 of EU Regulation 2016/679, we inform you that STARPUR SRL processes the personal data of Users who have voluntarily provided their data by filling in the “Contact” forms available on the website https://www.starwood.it/.
  1. Purposes of personal data processing

In accordance with the applicable law, the Data Controller guarantees that the processing of personal data is carried out in compliance with fundamental rights and freedoms, as well as the dignity of the data subject, with particular reference to confidentiality, personal identity and the right to personal data protection.
  1. All personal data provided by data subjects are processed for purposes related to:
    • fulfilling specific requests submitted by Users.
The legal basis for processing for the above purposes is Article 6(1)(b) of the Regulation, i.e. the performance of a contract or pre-contractual measures.

Personal data may also be used for purposes related to the promotional activities of STARPUR SRL services, such as:
  1. marketing purposes, including the receipt of commercial and promotional communications, such as proposals for new initiatives and information on new services via email, telephone or post, through implicit subscription to mailing lists owned by STARPUR SRL.
The legal basis for processing personal data for the purposes referred to in point 3.2 is Article 6(1)(a) of the GDPR, as the processing is based on consent.
  1. Provision of data and consequences of refusal to consent

The provision of your data for the purposes referred to in point 3.1 is necessary to allow the provision and management of the service. Any refusal to provide such data will make it impossible to use the service offered by the Controller.

With reference to the purposes referred to in point 3.2, consent to data processing is optional and may be given by selecting the appropriate checkbox for each specific purpose indicated at the end of this information notice. Failure to provide consent will not affect the possibility of receiving the requested services and will only result in the following consequences:
  • the inability to receive informational and promotional communications, including newsletters, from STARPUR SRL related to initiatives.
  1. Communication and disclosure of data

Personal data voluntarily provided by data subjects will not be disclosed in any way.

Where necessary, personal data may be communicated to:
  1. all subjects entitled to access such data pursuant to legal provisions;
  2. our collaborators, employees and suppliers, within the scope of their duties and/or contractual obligations related to commercial relationships with data subjects;
  3. postal services, shipping companies and couriers for the delivery of documents and/or materials;
  4. public and/or private entities, natural and/or legal persons (legal, administrative and tax consultancy firms, Judicial Offices, Chambers of Commerce, Municipality of Rome, etc.), where communication is necessary or functional to our business activities;
  5. banks for the management of collections and payments arising from contract execution;
  6. financial partners, within the scope of any contractual obligations.
Data may be communicated to third parties appointed as Data Processors pursuant to Article 28 of the GDPR. STARPUR SRL provides adequate operating instructions to any appointed persons or processors, with particular reference to the adoption and compliance with security measures, in order to ensure confidentiality and data security. The list of Data Processors and authorized persons is available at the Controller’s registered office. In any case, only essential and non-excessive data will be communicated with respect to the stated purposes. Transfer of data to third countries

The Data Controller does not transfer personal data to third countries.
  1. Methods of processing

Processing concerns common identifying personal data and is carried out using both paper and electronic tools, in compliance with all precautionary measures necessary to ensure security and confidentiality. Data are managed and protected in environments with controlled access, adopting appropriate technical, IT, organizational, logistical and procedural security measures, ensuring an adequate level of protection as required by law and allowing access only to authorized personnel.
  1. Data retention period

In accordance with the principles of lawfulness, purpose limitation and data minimization pursuant to Article 5 of GDPR 2016/679, personal data will be retained only for the time strictly necessary to achieve the purposes for which consent was given, specifically:
  • for the purposes referred to in point 3.1, for the time necessary to process user requests;
  • for the purposes referred to in point 3.2 (direct marketing and market research), until a request for deletion from mailing lists is submitted.
  1. Rights of data subjects

Data subjects may exercise the following rights at any time:
  • Right of access (Art. 15);
  • Right to rectification (Art. 16);
  • Right to erasure (“right to be forgotten”) (Art. 17);
  • Right to restriction of processing (Art. 18);
  • Right to data portability (Art. 20);
  • Right to object (Art. 21);
  • Right to withdraw consent at any time (Art. 7);
  • Right to lodge a complaint with the supervisory authority pursuant to Art. 77 GDPR (in Italy: the Data Protection Authority – http://www.garanteprivacy.it).

In relation to the Privacy Notice provided by STARPUR SRL pursuant to Art. 13 of EU Regulation 2016/679, having read the information regarding the sources, purposes and methods of processing, I hereby express my free consent.

Instrumental consent – Communications for contract execution

I consent to the communication of my data to STARPUR SRL and to subjects processing data on its behalf for the purposes referred to in point 3.1.

N.B. Instrumental consent is mandatory for individual clients/companies in order to provide the service.
